Ethics Terms and ConditionsThe Orange County Bar Association Ethics Committee will respond to inquiries on ethical matters. Any member of the association may submit an inquiry by use of the form below. A few caveats: 1. Published ethics opinions will not publicly reveal the identity of the lawyer making an inquiry or of any client or other person or entity involved in the situation. A letter of inquiry should not reveal any names except the inquirer's own name. 2. This committee will answer questions only about the inquiring attorney's own conduct, not about some other attorney's conduct. If a lawyer has a serious question or complaint about another lawyer's conduct, the lawyer should bring the situation to the attention of a grievance committee, not an ethics committee. 3. This committee ordinarily will not answer questions that are already the subject of litigation or that could be answered by the judge presiding over pending litigation. However, we will answer questions about a lawyer's proposed future conduct in litigation if the issue is not an appropriate one for a judge to decide. 4. Our committee will limit our opinions to matters addressed by the Rules of Professional Conduct. We reserve the right to rephrase an inquiry to bring it within the scope of the Rules or to address what we perceive to be a broader issue of interest to attorneys and the public. 5. We will not respond to any question that has been submitted to another ethics committee.[1] 6. Generally, it will take at least a month, and often several months, to issue written opinions. Therefore, lawyers should never expect a quick response to a request for a written ethics opinion.
